Is CBD legal in Hong Kong 2021?

CBD is growing at a really fast rate in Hong Kong. You may find CBD in cafés, bars, gyms, retail stores – they are everywhere! But still, CBD is a relatively new concept to many people. Many are still curious about the legal status of this benefits-rich compound, especially when they learn that CBD comes from the cannabis plant.

To clear up the confusion around CBD legal status, we must first understand:

What is CBD?

CBD is one of many compounds called cannabinoids that is found in cannabis. The main two cannabinoids THC and CBD interact with the human body through the endocannabinoid system, or ECS for short. The ECS is responsible for regulating bodily functions like sleep, inflammation, and anxiety. Cannabinoids, then, can be used to supplement the ECS to varying degrees.

Now, the main difference between THC and CBD is THC produces ‘high’, where CBD is entirely non-psychoactive. This has made CBD a very attractive, very legal, option for many looking to incorporate it into their lifestyle to improve their wellbeing and help people perform at their best.

 

Are all cannabinoids legal?

According to the Information on Cannabinoids Products published by Narcotics Division, Security Bureau HKSAR in February 2021, CBD is not a dangerous drug and is not controlled under the Dangerous Drugs Ordinance (DDO).[1] CBD is not psychoactive and does not have abusive potential.

On the other hand, cannabis, cannabis resin, and certain types of cannabinoids, namely tetrahydrocannabinol (THC) and cannabinol (CBN), are dangerous drugs controlled under DDO. Products containing THC or other dangerous drugs at any concentration are regarded as dangerous drugs and are regulated under DDO.

How to I make sure my CBD product is legal?

All CBD products would have been lab tested before launching to the market. The lab report is called certificate of Analysis, or COA. It helps ensure that a manufacturer's products are made to specification, and indicates the quantity of cannabinoids found in each product, like CBD. In addition to cannabinoids, this certificate should show details on the levels of heavy metals, pesticides, solvents, and THC found in an individual batch of products. ​COAs are meant to keep customers safe and informed, but they also help emphasize quality.
